Dinâmica do presidencialismo de coalisão: relação entre executivo e legislativo e o impacto da emenda constitucional Nº 32/2001.

Abstract

This work is a bibliographical review of the functioning and dynamism of coalition presidentialism in Brazil, especially in the Executive-Legislative relations. Its general objective is to evaluate the importance of the logic of a good political functioning, taking into account the attributions and interactions between Branches especially with regard to the forms of use of the Temporary Measures forth in art. 62 of the 1988 Constitution. The specific objectives are: to describe the branches’ role, to identify the structures of the political ordering and to suggest effective mechanisms in the development of coalition presidentialism, taking into account the checks and balances theory. The methodological procedures are structured through documentary analysis and bibliographical review based on Figueiredo and Limongi (1999, 1995, 2005), and (O'Donnell 1998) studies. It was verified that there are many difficulties for the implementation and consolidation of a good political base, in which the Executive Branch is aligned with the Legislative Branch, involving participation in Parliament and institutional control, as well as the monitoring of the President of the Republic by the National Congress, based on the amount of conversions in the Temporary Measures Law by the Legislator.
