Resumen:
This work was based on the need and relevance of investigating the relationship
between the executive and legislative powers Brazilian, comparing the requirements of
relevance and urgency, arranged in art. 62 of the 1988 Constitution, analyzing the
constitutional design, impact and institutional performance on the separation of powers
and checks and balances in government; checking the relevance of MPs in the
institutionalization of public policies; performing a survey of flow measurements
interim , additional laws and ordinary laws between the years 1994 and 2010 , as well as
an analysis of the impact of provisional measures in the paradigm of separation of
powers and checks and balances . The alteration of the constitutional regime of the
Brazilian Provisional Measures, after the adoption of Constitutional Amendment No. 32
does not remedied the deficit of legitimacy that is essential to any mechanism legislative
anticipation and that the Executive remains having means of political direction that
guarantee favored trading their agenda and their political choices in the face of
Parliament. It was found in this way, the alignment of the executive with the legislative
power, demonstrated by monitoring the agenda o f the President by Congress, indicated
by the amount of conversions Law o f provisional measures by the legislator.
