Abstract:
The political participation that is a necessary condition for the quality of democracy as already proclaimed Dahl and observed in the literature. In a democratic society the rights to vote and to be voted are constitutional guarantees that preserve the right to participation. The institutional design may end up prejudicing these rights, are the cases of ineligibility caused by conduct arising from past management of the alleged candidates. Judgments arising from Cortes de Contas, in the work on the screen the Court of Auditors of the Union, bring as a result condemnations / rejections of the management accounts that become a barrier to the candidate's desire to join the electoral process. Judgment by this external control may cause - or not - the suspension of political rights, thus generating the impossibility of political participation. The Electoral Court is responsible for decreasing this suspension, making an analysis of the causes that led to the conviction by the TCU of a candidate with real potential for gain, The survey found that the main position that obtained accounts judged irregular leading to rejection by part of TCU was the mayor, occupying the mark of 44.09% of the cases studied. As well as the main area harmed by the deviations of the conducts of the managers was the one of health. The type of conduct performed was also one of the variables of the study and it was verified that the great majority of the conducts were done together with others. The paper also makes an analysis if the ineligibility that stems from the judgment of the accounts by the TCU affects the political participation.
