Resumo:
The scientific and technological evolution brought very advanced methods and are increasingly used by society, but unfortunately, they are not accompanied by legislation, thus bringing numerous problems and dabates about the subject, which led to interest in the theme chosen. It was decided to use as a methodology for the elaboration of the work the deductive method, which seeks the specificities within the subject, if using also, bibliographical research, scientific articles, internet, doctrine, jurisprudence and legislation. The present work aims to analyze the possibilities of the conceived by artificial insemination post mortem to participate in the succession usually as a legitimate heir, discussing the main aspects of succession law, the specificities of human reproduction procedures, the constitutional principles intrinsic to homologous insemination post mortem and the doctrinal positions on the subject, noting that, as a rule, the lack of legal regulation on the subject generates numerous legal embarrassments that, certainly, will only be solved and pacified with its due regulation.
