Resumen:
From the dawn of humanity, the human being seeks to transform nature. Human activities, demographic growth and economic growth are causing environmental degradation. The Federal Constitution of 1988 sought to assure everyone the right to an ecologically balanced environment, while Municipalities in particular should legislate on matters of local interest. In this sense, this research elected the city of Aparecida, in the state of Paraíba, Brazilian northeastern semiarid, as a field to be studied regarding the protection of the environmental heritage, since the municipality has a great diversity of flora and fauna. In this sense, the objective of this research was to identify the main perspectives of the application of environmental legislation in permanent preservation area in the Municipality of Aparecida-PB. Methodologically, the research in question is an exploratory and descriptive documentary and bibliographic research, with a qualitative approach. The documentary research took place in March 2019 with the City Council of Aparecida of the city of Aparecida-PB, which allowed to locate two legifferent sources referring to the specially protected territorial spaces. The databases used for the literature review were legal provisions that contemplated the Environmental Law in the Municipality of Aparecida-PB, Paraíba and Brazil, as well as articles and other publications extracted from Scielo (Scientific Electronic Library OnLine). Two legislative provisions were identified: the Organic Law of the Municipality and the Complementary Municipal Law No. 026, which establishes the Participatory Master Plan of the Municipality of Aparecida. The critical point that we have pointed out is the legal establishment of a Zone of Agricultural Activities of Social Interest in Permanent Preservation Areas. In this context, it is worth asking - at the time when there is a suggestion for future research - how the surroundings of the Piranha, Peixe and Mutuca, Boi Morto and Grande streams are being preserved, where family-based agricultural activities are traditionally carried out. Given all that has been addressed throughout the present scientific production, it is concluded that there are two legal provisions legislated by the municipality of Aparecida, however, both the rulers and society itself must remain vigilant about the environmental needs that the city presents. and need it. Thus, it is noted how relevant are the works of this nature, because they bring a reality that we often do not care to discuss, thus, we consider as a most valuable contribution the concern that arises with the law and its consequences in the real life.
