Abstract:
The research focuses on the contextualization bias of transgenic products with a view to the balanced protection of the environment and the food security of consumers, based on the principles of rights and guarantees inherent to their application, revealing the need for reflections on production and marketing of products. genetically modified products for their use in human food in Brazil, which every day invades the tables of consumers, a controversial issue that is present, given that many studies show that such foods are potentially harmful to human health, and the right to the enjoyment of the balanced environment, violating the principles contained in the CDC and the Federal Constitution. The research has as its general objective the analysis of the limits and possibilities of production, commercialization of genetically modified food products, regarding the system of guarantees and protection of the environment and the consumer, in face of the balanced environment, health and food safety. As specific objectives, Understand the technical-legal evolution of environmental protection and consumer law as fundamental rights established by the Federal Constitution of 1988; Critically analyze the production process of genetically modified foods and their benefits and risks to human health; To consider the effectiveness of the protective system of environmental and consumer law, based on legal and jurisprudential precepts, in face of technological innovations in food production. As a research methodology, the deductive method was employed, considering that it will be based on the broader assumption regarding the limits and possibilities of production and commercialization of genetically altered foods, in view of the constitutional and infra-constitutional protection of balanced environmental protection and the food security, for construction and data collection I used the research technique: handled in bibliographic (books and periodicals) and documentary (reports and data provided by environmental protection agencies and consumers), through electronic databases. : Scielo, Digital Library of Theses and Dissertations, Capes Journals, Lexml and Google Scholar, as selection criteria will be taken into account the relevance to the proposed theme and the temporal criterion, with admission of works under 20 years. That said, given the findings presented, the direction to the principle of prevention, which has an impact on both environmental and consumer law, which states that in situations of suspected risks to the environment or the safety of consumers, the activity should be suspended until that scientific studies bring certainty about safety, or risks regarding production, because only in this way can we rationalize debates and protect human life and the balanced environment.
