Os impactos jurídicos e sociais das inteligências artificiais: à luz da resolução nº 615 do CNJ.

Abstract

This work aims to discuss the growing influence of technological tools and artificial intelligence (AI), which are redefining legal practice and impacting the interpretation and application of laws. The research seeks to analyze the effects of technology on judicial decisions, as well as its broader repercussions on Brazilian society.Accordingly, this study proposes a comprehensive exploration of the impacts of AI within the Brazilian legal system. The general objective of this research is to examine the consequences of using artificial intelligence in contemporary legal practice. The specific objectives are: To examine the legal implications arising from the adoption of these technologies, including issues of ethics, privacy, accountability, and security; To assess the social consequences of implementing technological tools in the legal field, considering aspects such as access to justice, inequality, and changes in the labor market; To propose recommendations to address the challenges and capitalize on the opportunities brought about by this transformation in the legal domain. The first chapter will present a literature review on artificial intelligence and its advancement within the Brazilian judiciary. The second chapter will analyze the social and legal impacts on the Brazilian legislative system, based on scientific literature and the changes that have occurred to date. This chapter will also highlight the rapid technological advancements—particularly in the field of AI—that are significantly reshaping the legal system and the lives of Brazilian citizens.The third chapter will focus on Resolution No. 615, dated March 11, 2025, issued by the National Council of Justice (CNJ), discussing its significance in regulating the use of AI in the judiciary. Finally, even with specific legislation such as CNJ Resolution No. 615/2025, it is imperative that the development of artificial intelligence be transparently and properly guided by legals frameworks, enabling society to monitor all processes involved in its creation and implementation. It is essential to uphold legal certainty, data protection, and anonymity, while ensuring that constitutional rights are respected and that AI systems do not perpetuate or exacerbate existing social inequalities.
