| ???metadata.dc.description.resumo???: | Infelizmente o abuso sexual infantil acompanha a humanidade desde as primeiras civilizações, independentemente de raça, cultura, poderio econômico ou credo, onde vê-se que, mesmo com a evolução da civilização, não se identifica um aparente diminuição de sua pratica. A tarefa de combater esta realidade complexa foi dada ao Poder Judiciário e órgãos afins. Ainda que os avanços das normas inerentes à tutela dos direitos dos jovens, praticamente, pouquíssimo se tem feito para a sua efetivação, tendo como foco somente punir o agressor, por causa da ausência de normas instrumentais específicas, definidas e compreendidas com clareza, acerca da proteção dos interesses das vítimas, instigando a chamada violência institucional. O abuso sexual infantil, infelizmente, não é uma coisa incomum, entretanto, há falta de denúncia, que se dá, muitas vezes por uma relação de dominação que o agressor exerce sobre a vítima, pela maneira como esse caso é recebido pela sociedade e como é conduzido pelas instituições judiciarias responsáveis. Imersa no universo dos interrogatórios, a criança, muitas vezes, causa confusão ao mudar seu depoimento daquele feito anteriormente, o que só reforça possíveis preconceitos sobre si mesma. Este estudo tem por objetivo geral analisar a participação de profissionais da psicologia e do serviço social nos processos criminais que envolvam crianças e adolescentes vítimas de abuso sexual, como forma de minimizar os danos psicológicos. Para isso, utilizou-se como método de abordagem o dedutivo, empregando-se como métodos de procedimento o observacional e monográfico e como técnica de pesquisa a documentação indireta. Demonstrou-se que o Depoimento sem Dano constitui a maneira pela qual profissionais do Direito, da Psicologia e do Serviço Social, podem corroborar para a busca da verdade real no processo, sem se desvencilhar da proteção dos interesses das crianças e adolescentes, possibilitando a redução de danos à essas vítimas de abuso sexual. |
| Abstract: | Unfortunately, Child Sexual Abuse has been present in humanity since the first civilizations, regardless of race, culture, economic power or creed, and even with the apparent evolution that civilization has gone through, it has not shown a way to decrease it. The task of combating this complex reality has been given to the Judiciary and related bodies. Although there are advances in the norms inherent to the protection of the rights of young people, practically nothing has been done to make them effective, maintaining the focus only on punishing the aggressor, due to the absence of specific instrumental rules, defined and understood objectively, about protection of victims' interests, instigating the so-called institutional violence. Child sexual abuse, unfortunately, is not an uncommon thing, however, there is a lack of denunciation, which is often due to a relationship of domination that the aggressor exercises over the victim, also due to the way in which this case is received by society and how it is conducted by the responsible judicial institutions. Immersed in the universe of interrogations, the child often causes confusion in his testimony when he changes in relation to the previously given, which only reinforces possible prejudices falling on himself. The general objective of this study is to analyze the participation of psychology and social service professionals in criminal proceedings involving children and adolescents who are victims of sexual abuse, as a way of minimizing psychological damage. To achieve this, the deductive method was used as the approach method, using the observational and monographic procedure methods and indirect documentation as a research technique. It has been demonstrated that the Testimony without Damage is the way in which professionals in Law, Psychology and Social Work can support the search for real truth in the process, without disentangling themselves from protecting the interests of children and adolescents, enabling the reduction harm to these victims of sexual abuse. |
